The DOT has very specific procedures that are both complicated and detailed. In general, the process is described below. For details please visit the links.

1. A violation occurs.

2. The employee or contracted individual is contacted by a company representative. Usually the MRO or the DER notifies the individual of a positive drug screen.

3. The employee must obtain an assessment from a qualified Substance Abuse Professional (SAP). Only a SAP can make a recommendation and have the employee in a position where the company can again allow them to perform safety sensitive duties. No one may perform safety sensitive duties after a violation without a notice of compliance from a SAP.

4. The SAP makes a recommendation based on the findings of the assessment process. THERE MUST BE RECOMMENDATION! A SAP must recommend education or treatment. The amount of either will be determined by the SAP.

5. The person in violation must follow through with the SAP’s recommendation. You can not return to safety sensitive duties without the SAP’s recommendation completed.

6. The employee attends a follow up evaluation. If they have successfully completed the recommendation, the SAP issues a notice of compliance to the employer.

7. The employer now decides if and when the employee returns to work.
